Native Title

Describes the rights and interests of Aboriginal and Torres Strait Islander people in land and waters according to their traditional laws and customs that are recognised under Australian law.

Where can Native Title exist?

  • Native Title can exist in areas where it has not been extinguished/removed
  • It can exist on
  • Vacant Crown Land, and other public or Crown lands
  • Forests and beaches
  • Oceans, seas, reefs, lakes, rivers, creeks, swamps and other waters not privately owned
  • National park and other private reserves
  • Pastoral leases
  • Land held by government agencies, or for Aboriginal communities.
